These Terms of Service (“Terms”) govern your use of the Fyzeeq mobile application, website, reports, and related services (“Fyzeeq” or the “Service”). By using the Service, you agree to these Terms and our Privacy Policy.
1. Eligibility
You must be at least 18 years old and legally able to enter into a contract to use Fyzeeq. By continuing, you confirm that you meet these requirements.
2. What Fyzeeq provides
Fyzeeq uses submitted information and AI-assisted processing to provide general physique observations, scores, muscle-development priorities, exercise suggestions, and progress tools. Features may be added, changed, limited, or removed as the Service develops.
3. Fitness and health disclaimer
Fyzeeq is an educational fitness tool, not a medical device or healthcare service. It does not provide medical diagnosis, treatment, physiotherapy, nutrition therapy, or a medically precise measurement of body composition. Reports are estimates and may be incomplete or incorrect because images, lighting, pose, clothing, camera angle, user information, and automated systems can affect the result.
Consult an appropriately qualified professional before changing your exercise or health routine, especially if you have an injury, condition, disability, pain, pregnancy, or other concern. Stop exercising and seek medical assistance if you experience pain, dizziness, breathing difficulty, or other warning signs.
4. Your photos and content
You retain ownership of content you submit. You grant Fyzeeq a limited, non-exclusive licence to transmit, process, and display that content only as necessary to provide and secure the Service. Upload only images of yourself that you have the right to use. Do not submit nude, underwear-only, sexually suggestive, illegal, abusive, or third-party images.
5. Purchases and subscriptions
Paid products may include one-time reports and recurring Pro subscriptions. Prices, included report limits, billing periods, and trial terms are displayed before purchase. Google Play processes payments under its own terms. Unless the purchase screen states otherwise, subscriptions automatically renew until cancelled through your Google Play account at least 24 hours before the end of the current period. Deleting the app does not cancel a subscription.
Refunds are handled according to applicable law and Google Play policies. Fyzeeq may change future prices or plan features with notice where required. A price change does not alter a completed one-time purchase.
6. Acceptable use
You may use Fyzeeq only for personal, lawful purposes. You must not misuse the Service, attempt unauthorized access, interfere with its operation, reverse engineer protected parts, automate excessive requests, bypass purchase controls, submit malicious content, impersonate another person, or use reports to harass, shame, discriminate against, or make high-impact decisions about another person.
7. Intellectual property
Fyzeeq’s software, brand, visual design, templates, text, and other service content are owned by Fyzeeq or its licensors and protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-transferable right to use the Service for personal purposes; they do not transfer ownership.
8. Third-party services
Fyzeeq relies on third parties for app distribution, billing, AI processing, authentication, and infrastructure. Their terms may also apply. We are not responsible for third-party products or services outside our reasonable control.
9. Availability and termination
We aim to provide a reliable Service but do not promise uninterrupted or error-free availability. We may suspend or terminate access where reasonably necessary for security, maintenance, legal compliance, misuse, or discontinuation. You may stop using Fyzeeq at any time; subscription cancellation must be completed through Google Play.
10. Disclaimers and liability
To the fullest extent permitted by law, the Service is provided “as is” and “as available”. Fyzeeq disclaims implied warranties that may lawfully be excluded. Fyzeeq is not liable for indirect, incidental, special, or consequential losses, lost profits, loss of data, or decisions made solely from a report. Where liability cannot be excluded, our aggregate liability is limited to the amount you paid for Fyzeeq during the 12 months before the event giving rise to the claim.
Nothing in these Terms excludes liability that cannot legally be limited, or reduces mandatory consumer rights available to you.
11. Governing law
These Terms are governed by the laws of Malta, without limiting any mandatory consumer protections you have in your country of residence. Courts with jurisdiction under applicable consumer law may hear disputes.
12. Changes
We may update these Terms as the Service develops. We will post the updated Terms and change the date above. If a material change requires consent, we will request it before the change applies.
